Terms and Conditions of Sale

PREAMBLE. These general terms and conditions of sale govern the remote sale of artworks (paintings, sculptures, and bas-reliefs) offered on the website www.choukry-benmansour.com by Choukry Benmansour, artist-author, registered with La Maison des Artistes and holding SIRET number 750 874 810 00013, hereinafter referred to as "the artist" or "the seller", and his clients referred to as "buyers". They apply to the exclusion of all other conditions. Placing an order implies the buyer's full and unreserved acceptance of these terms and conditions.

ARTICLE 1: INFORMATION REGARDING THE ARTWORKS Each artwork offered for sale on the site is an original work, a unique piece (unless explicitly stated otherwise). The essential characteristics (title, dimensions, technique, support, price) are presented on the site. Prices displayed are in euros, net of VAT (VAT non-applicable, art. 293 B of the CGI).

ARTICLE 2: ORDERING The buyer selects the artwork they wish to acquire. Order confirmation entails acceptance of the prices and descriptions available at the time of purchase. Since adding an item to the cart does not constitute a definitive reservation, the artist declines all responsibility in the event that a third party purchases the artwork in the meantime.

ARTICLE 3: PAYMENT Orders are paid for exclusively by bank transfer. The processing and dispatch of the order begin upon receipt and effective validation of payment in the artist's account.

ARTICLE 4: DELIVERY AND SHIPPING COSTS Shipping costs within metropolitan France are free. Shipment is handled by La Poste (or a specialized carrier depending on the format) in secure and adapted packaging, with insurance included. Each artwork is delivered with an invoice and a certificate of authenticity signed by the artist.

ARTICLE 5: RETENTION OF TITLE Artworks remain the exclusive property of the artist Choukry Benmansour until full and final payment of the sale price has been received.

ARTICLE 6: RIGHT OF WITHDRAWAL AND RETURNS The buyer has a period of 5 business days from the receipt of the artwork to exercise their right of withdrawal. The artwork must be returned to the artist's address in its original condition and secure original packaging, accompanied by its invoice. The risks of return transport as well as return shipping costs remain entirely the responsibility of the buyer. If the returned artwork is damaged, deteriorated, or if the packaging proves insufficient, no refund will be issued. The artwork will then remain at the buyer's disposal, who may request that it be returned to them exclusively at their own expense (prior payment of return shipping costs required).

ARTICLE 7: INTELLECTUAL PROPERTY The website content and the artworks presented are protected by copyright. Any reproduction, distribution, or representation, total or partial, without the prior and express consent of the artist is strictly prohibited and constitutes counterfeiting.

ARTICLE 8: APPLICABLE LAW These general terms and conditions of sale are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority before taking any action before the competent courts.

ARTICLE 9: CONSUMER MEDIATION In the event of a dispute between the Client and the company, they shall endeavor to resolve it amicably. Failing an amicable agreement or in the absence of a response from the professional within a reasonable timeframe, the consumer may refer the matter free of charge to the competent mediator registered on the list of mediators established by the Evaluation and Control Commission for Consumer Mediation. The artist adheres to the Consumer Mediation Service of the SMP (Société de la Médiation Professionnelle). In the event of an unresolved dispute directly with the artist, the consumer may use the mediation service free of charge by visiting the website www.mediateur-consommation-smp.fr or by postal mail to the mediators referenced by the SMP (Alteritae, 5 rue Salvaing, 12000 Rodez).
